1. Please note: by signing up for any of our services you agree to be bound by all Calco UK Ltd terms and conditions. Calco UK Ltd - Registered in Scotland at companies House Company Number 303287

2. Welcome to Calco UK Ltd Web Services (also referred to in this document as Calco or Calco UK). The staff at Calco UK Web Services do our best to provide an environment that will encourage the technological growth of its Clients. These Terms of Service are provided to detail the responsibilities of Calco UK Web Services's members.

Except for express undertakings to indemnify and any warranties set out in this Agreement:

a) To the extent permitted by the law, Calco UK Ltd expressly excludes all conditions and warranties whether express or implied.

b) Notwithstanding any other provision in this Agreement, in no event will Calco UK Ltd be liable to any party including the Customer for any indirect, punitive, special, incidental or consequential damage in connection with or arising out of this Agreement (including for loss of profits, use, data, or other economic advantage), however it arises, whether for breach of this Agreement or in tort, and even if Calco UK Ltd has been previously advised of the possibility of such damage. Further, liability for such damages shall be excluded, even if inclusive remedies provided hereunder fail their essential purpose. The Customer will indemnify Calco UK Ltd and keep it indemnified from and against any claims by any third party for or in respect of such damage
s.

These Terms of Service govern the use of the Calco UK Web Services website and webspace.
The term "Calco UK Web Services" is used to refer to Calco (UK) Ltd.
The term "Services" refers to consultancy, web site hosting, web design and implementation, domain name registration, and any other service or facility provided by Calco UK Web Services to you.
The term "Hosting" means hard drive space on a server provided by Calco UK Web Services to you for use as a web site on the Internet.
The term "membership" refers to the access, content, and services that Calco UK Web Services provides to its members.
By subscribing to Calco UK Web Services for any of the above services or products and thus becoming a member, you agree to these Terms of Service.

By purchasing any of our products you agree receive our Newsletter (approximately 12 times per year). The Newsletter is our PRIMARY method of broadcasting Updates, Changes to Terms and Conditions and Price Changes.

Calco UK Web Services reserves the right to cancel any membership, including files and content, for any reason, or no reason at all, at any time. You agree to maintain back-up files of all information you post on Calco UK Web Services and you agree that Calco UK Web Services will have no liability for removing any data you have posted.

Calco UK Web Services reserves the right to cancel membership if any member re-sells the web space or services and / or software to third parties.

Calco UK Web Services reserves the right to access and review its members content, files, or web pages for any reason at its sole discretion.

Calco UK Web Services does not permit any of the following types of content:
•nudity, pornography, anything of a sexual, lewd, or obscene nature
•violations of any copyright or any other right of any third party
•threatening, abusive, harassing, defamatory statements
•promotion of illegal activities (info on hacking, cracking, making illegal devices, etc)
•information, instructions, or software containing or about any kind of virus
•spamming scripts, viral scripts, malicious scripts of any kind. Any programmatic device liable to harm the server or cause inconvenience to any other user (see AUP)
•hate speech or hate propaganda
•information of a terrorist nature
•high bandwidth material or streaming material such as video or MPEGs (.mpg files)
•use of member web space as storage for the purpose of loading remotely
•use of member web space as a doorway, signpost, or gateway to another website
•content that links to content that violates Calco UK Web Services's Terms of Service
•misrepresentation of member's identity, or the impersonation of anyone, including Calco UK Web Services personnel
•collection of personal information for illegal purposes
•content that is deemed by Calco UK Web Services, in its sole discretion, to be harmful to Calco UK Web Services, another company or organization, or individual
•solicitation or sale of any products or services that are harmful, illegal, dangerous, pornographic, or indecent

Contravention of any of the above rules will cause termination of hosting on a temporary or permanent basis.

Calco UK Web Services member name restrictions are as follows:
*No vulgar or offensive language
*No use of a name other than your own unless legally authorised.
*No use of a name that is an organization or entity other than your own
*No use of a name that is trademarked, copyrighted, service marked, or violates the rights of another individual or organization

Actions that may cause termination of membership:
*Purposely circumventing the above rules and terms
*Posting or providing links to content that violates these Terms of Service
*Displaying any paid advertising on your member website (without prior permission)
*Using a membership that is not yours or hacking into any other members account.
*Sending unsolicited (bulk, spam) email from or referencing your space
*Posting archives or images of whatever size for the purpose of leeching
*Reproduction or use of another member's content without permission

Calco UK Web Services does not preview the content of it's members and therefore all member content is provided to "AS IS" and without any warranty or any kind by Calco UK Web Services.

Calco UK Web Services is not responsible for any content, opinions, or views expressed by it's members on or in their web space, message forums, or contributions to communal posting areas.

Calco UK Web Services does not endorse any content contained within it's member's pages.

By submitting or uploading files/content/web pages to Calco UK Web Services, you grant Calco UK Web Services and its affiliates a royalty-free, nonexclusive, worldwide, unrestricted license to use, copy, transmit and distribute the content for the purpose of promotion of the member's website or promotion of Calco UK Web Services.

Calco UK Web Services will cooperate with all law enforcement efforts pertaining or involving the use of Calco UK Web Services's member's web space and content. This may result in Calco UK Web Services disclosing all information given to Calco UK Web Services including but not limited to information contained in member's profiles.

3. DOMAINS
DOMAIN NAME REGISTRATION

Calco UK will register your domain name by proxy. You will own the name for the period of validity, usually ONE year, so long as the name has been paid for in full by you in as much as it will remain on Calco UK servers and that transfers to another agent will not be initiated without payment of the domain transfer fees in full.

Calco UK will charge a fee for the transfer of names equivalent and or greater to the total fees charged by any participating parties involved in the transfer.

The use of any domain name supplied by Calco UK is regulated by the appropriate Naming Authority and their individual Terms and Conditions. (.com refer to Network Solutions, .co.uk refer to Nominet etc)

Calco UK shall bear no liability for failure in re-registering the domain name or from problems informing you that it is due for renewal.

It is the REGISTRANT'S responsibility to ensure that the

4. PAYMENT
All fees are due in advance. Larger payements for websites etc are due in STAGED PAYMENTS

1) up to 1000 pounds - two stages of 50 percent. a) 50% in advance and b) 50 percent not more than 14 days after completion.

2) 1000 - 5000 pounds - three stages - to be agreed before work commences.

3) 5000 pounds and above : stages as per agreed schedule of works / contract.

Failure to pay within our stated terms (clearly printed on every invoice issued) will result in an additional charge being added to the invoice on each successive re-issue. All goods and services remain the property of Calco UK Ltd until paid for in full.

5. NON PAYMENT
In the event invoices are not paid within 30 days of issue, expiring services will be terminated until such times as the invoice is settled in full. Services switched off due to non-payment will incur a RECONNECTION FEE. Late payment and reminders will incur a surcharge of 5 pounds GBP per notice. Calco UK Ltd shall also be entitled to charge such reasonable costs as it may incur in recovering any overdue balances.
NOTE: All services supplied by Calco UK Ltd remain the property of Calco UK Ltd until paid for in full.

6. CONTRACT RENEWAL / CANCELLATION
Domain names and hosting must be paid for in full and in advance. Unless notified at least 45 days in advance we will automatically renew your domain name(s) and hosting contracts and invoice you accordingly. This process becomes non-reversable at 31 days before the date of renewal. By purchasing a domain or hosting contract (including email accounts), you agree to the automatic renewal process. Automatic renew protects your domain from accidental deletion.
DELETION : When DOMAINS are transferred, ALL content is suspended or deleted. IT IS THE SOLE RESPONSIBILITY OF THE NEW HOST to run both email and web via their nameservers. Calco UK Ltd will not be liable for the deletion of any data (email or website) unless a request is made in writing (includes email) asking to retain the data or maintain service(s).

7. BROADBAND CANCELLATION & MAC CODE ISSUES
Broadband is paid for in full and in ADVANCE. Failure to do so will result in the termination of your broadband and pursual of balance outstanding trhough the Scottish Legal System
Invoices are sent out in advance of payment due and paid in full as follows:
All monthly accounts must be paid in advance by Direct Debit or Visa / Mastercard Mandate
All quarterly accounts must be settled within 7 (SEVEN) days of datepoint on invoice.
All annual accounts must be settled within 30 (THIRTY) days of datepoint on invoice.

8. CANCELLATION
We require 5 weeks notice in writing from you of your intent to cancel broadband. Calco UK Ltd are required to give BTW, notice of at LEAST 32 days plus a shutdown period.

In effect this means 5 (FIVE) weeks notice minimum is required from you. Although this cancellation period seems somewhat lengthy, Broadband is something that you should not change on a whim and the suppliers rules and regulations that we must adhere to reflect this. You are however entitled to a MAC code so that you can change your Broadband supplier with relative ease and speed. (Updated Feb 14 2007)


9. WEBSITES
Calco UK will not be held liable for any loss of business due to errors or omissions of pages designed and uploaded by Calco UK or pages directly uploaded by the members. It is the responsibility of the client to check ALL new material and updated web pages for accuracy and legality

Similarly it is YOUR responsibility to maintain proper and decent content on your website hosted by Calco UK Ltd. If we find contravening content we will delete immediately. Any illeagal content will be reported to the Police or appropriate authority.

It is your responsibility to ensure your website's IP ADDRESS references are update as necessary when the webservers are migrated or updated. Calco UK will not bear any costs associated with these harware or software updates and/or upgrades. For example if php, perl or any other service running on the server is updated and your website / application fails, Calco will not be liable for any losses. Similarly we replace servers on a regular basis at which time IP ADDRESSES change. It is your responsibility to ensure your website's IP ADDRESS references are update as necessary when the webservers are migrated or updated. Again Calco will not be liable for any losses incurred due to website failure.

10. EMAIL

If you expect to create more than one email acount you must delegate someone within your company with reasonable IT skills to act as suport liaison. All queries regarding installaton/set-up etc must come via this representative. We do this becuse we simply do not have enough support staff to handle the increasing number of email software platforms and number of email accounts. EMAIL HELP can be found here. Please DO contact us though if your email STOPS working for any reason.

Bulk Email LImits:-

IMPORTANT - PLEASE NOTE The following limits change at the telehouse where our servers are located (regularly) - so if you are concerned about limits on email - please call +44 0 1599 534964 for the latest limit data)

At the time of writing :-
Bulk Email Maximums: 10 per 30 sec - 50 per 10 minutes - 1000 / 24 hrs.
Max attach = 20mb* per email. (30mb on Exchange boxes)
*As email attachments are "joined" every so often so the eail can be sent as text, the joining actually uses some of this allocation. Realistically you should not try to send anything bigger than 15mb in any one email. We can set up FTP for you if required or you can use a third party service like drop-box.

Calco UK policy on maintaining stable data-transfer levels includes a deletion process for email as follows: (i) all mail in IMAP Trash folders will be deleted automatically after 7 days. Such mail is checked for nightly; (ii) if a mailbox is not accessed for 60 days, either by POP or IMAP, all mail over 90 days old will be deleted automatically. This process will be repeated nightly until the mailbox is accessed again; (iii) Root mailboxes that are not accessed for 90 days will have their quota reduced to 1MB automatically (with any existing mail over this new quota deleted). If the Root mailbox is accessed again, its quota will be increased back to the original 50MB* (Root mailboxes being Standard mailboxes). Note that after 90 days, the Root mailbox will have already undergone a cleanup after 60 days of inactivity. Calco UK does not accept any responsibility whatsoever for any deleted mail.

THE ABOVE TERMS DO NOT INCLUDE EMAIL HOSTED ON OUR OLDER SYSTEMS
*50MB LImit applies to boxes created around or after October 2008 - you may upgrade 20mb boxes free of charge. The mail box must contain NO email during the upgrade process.

11. NOTIFICATION OF SCHEDULED UPGRADES
Users of the Calco UK Ltd network must regularly check the SYSTEM STATUS PAGES or HELP pages to ensure they are aware of ANY and ALL SCHEDULED server upgrades. Calco UK Ltd will not be held responsible for any data loss or revenue loss as a result of server re-configuration(s) or upgrade(s). This specifically applies to service upgrades, software patches and software upgrades.

12. COPYRIGHT
All images and data on the Calco UK Network which includes and is not limited to : Lochalsh.com madeinscotland.biz, madeinscotland.info, First Choice Domains, Highlandsofscotland.co.uk and Calco UK.com are copyright 2000 to 2014 Calco UK Ltd.

  6. DIRECT FEED FROM OUR WEBCAMS is strictly forbidden and is considered file leeching or theft. Anyone using our webcams in this manner will be invoiced accordingly with a minimum fee of 50 pounds (GBP) per day. This is a direct infringement of copyright.

  7. Linking to any page or part of a page must be as a whole page and must not carry ANY branding by anyone other than the Calco UK Network without prior writtem permission.

The default copyright, unless otherwise agreed in writing, of sites built by Calco UK Ltd for clients is as follows:

Calco UK owns the copyright of the CODE, DESIGN, IMAGES, WEBCAM FEEDS and LOGOS DESIGNED BY CALCO.
Domain Names have no copyright and are sold by Calco UK under the terms of the issuing REGISTRY. Calco UK Ltd are FULL voting members of NOMINET UK the authority resposnsible for issuing UK domains.
( The REGISTRANT legally and fully HAS the right to use the domain for the paid period and will be given exclusive opportunity to renew at reasonable notice within each renewal period)

13. CERTIFICATES
Once paid for in FULL initially and at renewal times, owners of domains fully own their domains registered by Calco UK. Domain certificates are no longer issued. Instead owners should use the appropriate WHOIS database.

The official bodies for the Registration of Domain Names called REGISTRIES hold all the documentation on-line in electronic form. This means (for better or worse) that ANYONE can inspect the legal owner of a domain, yourself included.

You are the legal owner of the domains if you are specified as REGISTRANT. There are legally binding international laws that guarantee this.

15) Cancellations of Appointments
Appointments may be cancelled a minimum of 24 hrs beforehand. Notification must be received by the corresponding time on the previous working day. ie If the appointment is on a Monday, notice should be given by the end of the previous working day giving over 24 hours notice. Cancellations on the day for any reason are charged at the full rate for the appointment but the fee may be waived at the discretion of Calco UK Ltd.
Free or included training must be used within 30 days of offer.


SYNOPSIS:
This synopsis is only provided for guidance in plain English outlining what Calco UK Web Services’s responsibilities are (and are not)
1) Calco UK will try to maintain a reasonable service of web hosting and services however we will NOT be liable for breaks in service or loss or corruption of your data including email, for any reason. Further we will not be liable for loss of business or revenues suffered by you due to suspension of services for any reason.
2) We reserve the right to withdraw our services for any reason.
3) We will not be responsible for Domain Names that expire. It is YOUR responsibility to renew these services in advance.
4) If your domain/hosting is suspended for non-payment, there is a reconnection fee currently a minimum of 25 pounds.

5) Calco UK WILL charge a fee for transfer of domain name(s) to another agent if the domain incurs costs (to Calco UK), otherwise the transfer is FREE.

6) Calco UK will not be held liable for any loss of business resulting in errors / omissions in web page content or server down-time.

WORDPRESS, WORDPRESS XTEND and CONTENT MANAGED SYSTEMS (all are referred to as CMS below)

We deliver A FRAMEWORK or CMS which can then be edited by the customer. The CMS is NOT a finished website.

No support is offered for the management or editing of the aforementioned CMS's unless agreed by formal contract.

ALL CMS's delivered must be reported as incomplete or faulty within 14 days of delivery. The Handover period exhausted ANY and ALL alterations to the website are at the customer's expense.

All CMS should be backed up by the customer and Calco UK Ltd accept no liability for losses due to server failure or infection.

Malicious Code is common - please read about it as we will shut down ANY site infected by malicious code.

You are not permitted back-up or non-website files on the server (your webspace). Please use a commercial back-up service or Dropbox (free service), MyRepono, Amazon etc. Please refer to our AUP section 2.1.8 for full details.

BACK-UPS (7 day paid service)

Our commercial back-up service :-

At the end of a 7 day cycle your back-up will OVERWRITE the previous week’s back-up.

Example : if you make a back-up on Monday; the following week... the previous Monday’s back-up will be over-written with fresh data from this Monday REPLACING the old data from the previous week. The same back-up service is run for each and every day of the week.

The backups are automated. However we also monitor each backup personally and on a daily basis; holidays and some weekends excepted. If a problem is encountered we will endeavour to resolve the issue immediately.

Please note that the service fees only cover the daily back-up. Re-installing the website from a specified back-up is charged at the hourly rate of 65 pounds per hour. (Most medium sized websites 1GB are effectively restored within 1 hour).
Also ... If a server crashes ( hardware failure ), our tape back-up restores all the websites thereon automatically starting at websites beginning with “A” and ending at “Z”. We have NO CONTROL over this procedure and so customers simply have to wait. On a busy server this can take 4 days. However while there is no charge for the restoration of your website, no refunds are given on daily back-ups fees.

 

7) Newsletters : Please ensure you are able to receive our Newsletter as its contains all price changes, changes to terms and general notifications about our services and products. Below are some tips to prevent our Newsletter being sent to the spam folder or deleted! This is called WHITE LISTING - SAFE SENDER - FRIENDS etc.

At the top of an email received from us there will be a FROM address that says sales@calcouk.com Please right click this and choose "Add To Outlook Contacts". THis will add us to your address book. If this doesnt work and sales@calcouk.com ends up in the JUNK or SPAM folders; find the email line in the junk folder; right click it and choode NOT JUNK. Outlook should then offer a box saying with options to always treat sales@calcouk.com as genuine email. Choose the most appropriate.

For Outlook 2007 
To make sure you can see emails as they were intended to be seen (including images), add our email address to your address book and safe sender list.
To add our email address to your address book: 
1. Right click on the "From Sender" email address
2. Choose "Add To Outlook Contacts".

Hotmail/MSN mail 
1. Sign in and click ‘Options' in the top right of your screen. 
2. On the left side of the page, click 'Safe and blocked senders' which is under the 'Junk email' section.

4. Add the address or domain name, and click‘Add to list'.

Gmail 
1. From your Gmail inbox, open the Isle of Skye Estate Agency email you have received 
2. Click on the arrow next to the reply button on the top right hand corner of the email 
3. From the drop down menu, click on "Add sender to contacts"

Yahoo Mail
1. Click on 'Contacts' in the menu on the left of the page 
2. Click 'Add contacts' 
3. Add Name and email address 
4. Save contact details .

For AOL 
To add our email address to your Address Book or Custom Sender List:
*AOL9.0:
1. Click the "Spam Controls" link (lower right area of your inbox).
2. When the "Mail & Spam Controls" box appears, click "Custom sender list".
3. Choose "allow email from " option
4. Add the domain iosea.co.uk
5. Click "Add", then "Save".
*AOL 7 & 8:
1. Go to Keyword Mail Controls.
2. Select the screen name you are using to receive email.
3. Click "Customize Mail Controls For This Screen Name."
4a. For AOL version 7.0: In the section for "exclusion and inclusion parameters", include the following domain: * @iosea.co.uk
4b. For AOL version 8.0: Select "Allow email from all AOL members, email addresses and domains."
5. Click on "Next" until the "Save" button shows up at the bottom.
6. Click "Save."

Mozilla Thunderbird

Simply add our email address sales@calcouk.com to the Thunderbird Address Book and configure your Junk Mail Controls to whitelist your address book.
